Plantronics Email Sign up Sweepstakes Official Rules ("Official Rules")

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. THE SWEEPSTAKES IS INTENDED FOR THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT PARTICIPATE IN THIS CONTEST IF YOU ARE NOT A UNITED STATES RESIDENT.

1. DESCRIPTION: The Plantronics Email Sign Up Sweepstakes (“Sweepstakes”) is solely sponsored by Plantronics, Inc. (“Sponsor”) located at 345 Encinal Street, Santa Cruz, CA 95060, United States.

The Sweepstakes consists of fourteen (14) monthly sweepstakes (“Monthly Sweepstakes”) starting and ending at the dates and times as described in the table below. Entries from one Monthly Sweepstakes will not be carried forward to subsequent Monthly Sweepstakes.

2. ELIGIBILITY: To enter and be eligible to win, you must be a legal resident of the 50 United States, or Washington, D.C.,  be 18 years of age or older and at least the age of majority in your jurisdiction of residence. Persons in any of the following categories are not eligible to participate or win: (a) any person who, during the Sweepstakes Period, was or is a director, officer, employee, or agent of Plantronics Inc. (the “Sponsor”), or affiliated companies, divisions, dealers or service agencies, or independent contractors of the Sponsor; (b) persons who are or purport to be immediate family members (defined as biological or step-mother, father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person described in category (a).

3. HOW TO ENTER:  Opting-in to receive email communication from Plantronics, Inc. during the Sweepstakes Period will result in an automatic entry into the Sweepstakes.

4. WINNER SELECTION AND NOTIFICATION: Plantronics will randomly select one potential winner from the entries received during a Monthly Sweepstakes period as provided in the table above.  Winners will be notified via email and will have one week from the notification date to respond to the email and claim the prize.

5. PRIZES:  One gift card in the amount of $250.00 USD will be available for each Monthly Sweepstakes period.. Limited to one prize per person and / or mailing address.

6. PRIVACY POLICY:  The Sweepstakes will be operated in accordance with Plantronics’ Privacy Policy.  The Plantronics Privacy Policy can be accessed in its entirety at http://www.plantronics.com/us/privacy/. 7. GENERAL TERMS AND CONDITIONS: Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or winner's failure to adequately monitor any account. If a potential winner fails to respond within seven (7) days of notification, is found to be ineligible or not in compliance with these Official Rules, declines to accept the prize, or in the event a prize notification or prize is returned as undeliverable, or Sponsor is unable to contact the potential winner, the prize will be forfeited, and at Sponsor's discretion, an alternate potential winner may be selected. The prize will be shipped within seven (7) days from the date the potential winner responds to the notification email to claim the prize.  Potential winners may be required, except where prohibited, to execute and return an Affidavit of Eligibility/ Release of Liability and Publicity Release, as well as the W-9 form as required by the IRS. Potential winners may be required to provide proof of identification, such as but not limited to a valid driver's license. Except where prohibited, participation in the Sweepstakes constitutes participant's consent to Sponsor's use of entrant's name, likeness, voice, opinions, biographical information and hometown for promotional purposes in any media without further payment or consideration.

Sponsor also reserves the right, in its sole discretion, to suspend or cancel the Sweepstakes at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or participation in the Sweepstakes.  By submitting an entry for the Sweepstakes, you agree to abide by these Official Rules and any decision Sponsor makes regarding this Sweepstakes, which Sponsor shall make in its sole discretion. Sponsor reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in Sponsor's reasonable suspicion, tampers with Sponsor's site, the entry process or violates these Official Rules.

Neither Sponsor nor its employees, representatives or agents are responsible for lost, interrupted or unavailable network, server, satellite, or other connections, availability or accessibility; or miscommunications, failed computer, or technical failure; delayed or misdirected transmissions; or any other errors of any kind whether human, mechanical, electronic or network.

IN NO EVENT WILL SPONSOR, ITS PARENT, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR RESPECTIVE ADVERTISING OR PROMOTION AGENCIES, ANY COMPANIES PROVIDING PRIZES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (TOGETHER, "RELEASEES"), BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE PROMOTION OR TRAVELING TO OBTAIN OR USE OF ANY PRIZE. THE SWEEPSTAKES AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. BY PARTICIPATING IN THE SWEEPSTAKES, EACH PARTICIPANT AGREES TO HOLD RELEASEES HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND IN CONNECTION WITH THE SWEEPSTAKES OR RESULTING FROM ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE, AND CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY.

This Sweepstakes and the rights and obligations of Sponsor and participants will be governed by and controlled by the laws of the State of California, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of California, Santa Cruz County. The parties consent to the jurisdiction of the state courts of California and federal court located within such state and county with respect to any action, dispute or other matter pertaining to or arising out of this Sweepstakes.
